1. Agreement to Terms

By using our Service (dropavif.com website and Media Optimizer WordPress plugin), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Service.

2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

3. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select.

We use a third-party payment processor, Stripe, to handle payments. By submitting your payment information, you grant us the right to store and process your information with the third-party payment processor.

4. Fair Use Policy

While our subscription plans offer "unlimited" optimization credits, this is subject to a fair use policy. The service is intended for typical use cases for websites and blogs. We reserve the right to limit or suspend accounts that exhibit excessive, abusive, or automated usage patterns that negatively impact the stability of our service for other users (e.g., using the service for bulk image processing for third parties).

One-time credit packages are not subject to this fair use policy and can be used at any rate.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Limitation of Liability

In no event shall DropAVIF, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
